TRANSPORTATION DEVELOPMENT PROGRAM

CONSULTING CONTRACT

GRAND COUNTY, ("Grand") and JACKSON COUNTY ("Jackson"), both of which are political subdivisions of the State of Colorado and LSC TRANSPORTATION CONSULTANTS, Inc. a Colorado corporation ("Consultant"), make the following agreement as of the 3rd day of February, 2000.

RECITALS

A. Grand and Jackson have cooperated with residents and governmental and business entities of Grand and Jackson Counties to form the .Transit Advisory Committee ("TAC") for the purpose of evaluating and identifying the transportation needs of Grand and Jackson County residents and possible plans or strategies to meet those needs. As used in this Contract, "TAC" shall mean the voting and non-voting members of the TAC as consisting from time to time, and any subcommittees thereof.

B. .Grand and Jackson desire, on an as-needed basis, to avail themselves of Consultant's expertise with respect to matters involving the study of transportation needs and resources in Grand County and Jackson County, Colorado and the creation of Transportation Development Plan(s) (TDP) for the development and utilization of transportation resources in Jackson and Grand Counties and

C. Consultant is willing to act as an independent contractor with respect to such matters as may be mutually agreed upon. As used herein, "Consultant" shall mean LSC Transportation Consultants, its subcontractors, and their respective officers, directors, shareholders, employees, staff and agents. Further;

D. Grand and Jackson (hereafter collectively referred to as the "Counties") desire to contract with Consultant to provide advice to TAC as described in Paragraph 1 below.

AGREEMENTS

NOW, THEREFORE, the Counties and Consultant agree as follows:

1. a. The services to be performed by consultant will include but may not be limited to the matters described as Tasks 1-9 on Exhibit A hereto, which is incorporated herein by this reference ("Services"). Any tasks which are not identified on Exhibit A as being the responsibility of the Counties/TAC but which are necessarily implied in order to successfully complete Tasks 1-9 thereon shall be within the scope of Consultant's Services.

b. The Services provided pursuant hereto by Consultant shall be performed or personally supervised by A.T. Stoddard and Corinne Donahue. Consultant understands and agrees that the Counties have entered into this Contract for the purpose of obtaining the services of A.T. Stoddard and Corinne Donahue and would not have so contracted if their services were unavailable. The Counties have also entered into this Contract for the purpose of obtaining the services of Consultant's subcontractor, James Charlier of Charlier Associates. If their services shall become unavailable for any reason, this Contract shall be immediately terminable at the Counties' option.

c. Except for utilization of the services of James Charlier of Charlier & Associates to which the Counties hereby consent, unless otherwise agreed in writing by the Counties, Consultant shall not use and the Counties shall not be obligated to pay any fee or expenses related to Consultant's use of any agents or subcontractors in connection with providing the Services. If the Counties approve the use of any agents or subcontractors, then Consultant shall ensure that such parties including James Charlier and Charlier & Associates, comply fully with the agreements, covenants and obligations of Consultant hereunder, including without limitation those obligations set out in paragraphs 9 and 14 below, and Consultant hereby assumes full responsibility for all loss or damage caused by or resulting from the actions or omissions of such parties.

d. Consultant guarantees to perform the Services to the reasonable satisfaction of the Counties and the TAC. If additional information or analysis is required following completion of the Services, Consultant will complete such work at no cost to the Counties for staff efforts.

e. TAC shall administer this agreement for and on behalf of the Counties and the TAC membership Consultant will take direction only from TAC. Consultants shall take direction only from the TAC chair, as a representative of TAC, its membership and the Counties. Consultant will not perform work for TAC at the direction of any other TAC member without written direction from the TAC chair to do so. In the event Consultant does work other than at the direction of the TAC chair, the Counties shall have no obligation to pay therefore. Further, Consultant designates A.T.Stoddard as its primary contact person with the TAC chair.

2. a. This Contract shall be effective for the period beginning February 3, 2000, and ending November 2, 2000 or upon completion of the Services, whichever is later ("Expiration Date") except that the provisions of Paragraphs 9, 10, 13 and 14 below shall continue to be binding beyond the Expiration Date.

b. Consultant agrees and understands that the total amount paid for the Services shall not exceed thirty-nine thousand eight hundred sixty-six dollars ($39,866) ("Contract Maximum") and Consultant shall fully complete all the Services for an amount not exceeding the Contract Maximum. Consultant's hourly charges for the time of its personnel and subcontractors shall not exceed that set out in that Table 1, Cost Estimate, provided to the TAC on January 6, 2000.

3. Consultant will determine Consultant's work hours and the methods of performing the Services and shall function hereunder as an independent contractor. It is understood that as part of the Services, Consultant will:

a. Submit to the TAC chair by e-mail: a weekly report, two technical memoranda, a draft TDP, such other reports as deemed appropriate and/or agreed by Consultant, a final written TDP at the completion of the Services, and such other reports more often as may be reasonably requested by the TAC ; and

b. Timely provide to the TAC originals, hard copies and electronic copies of its Technical Memoranda and draft and final TDP as described on Exhibit A attached hereto and post e-copies of such documents on a publicly available website for comment; and

c. Perform such other related services, attend TAC and public meetings in Grand and Jackson Counties, and meet with TAC personnel and personnel or representatives of Grand and Jackson and towns or communities located therein as TAC may reasonably request and direct.

d. Upon written direction from TAC, Consultant will immediately cease all work related to the Services.

4. The consultant shall not be a member of the TAC, nor participate in the decision-making process of the Counties or TAC. Consultant shall not be an agent or employee of the Counties or TAC.

5. It is understood by all parties that the Counties will not withhold for federal taxes, state taxes or FICA, and that Consultant is solely responsible for these taxes with respect to Consultant. The Counties will not provide insurance or other benefits for Consultant nor will Consultant be eligible for coverage under any worker's compensation programs or insurances of the Counties, TAC, or any of its members or participants.

6. Consultant will provide Consultant's own equipment and vehicle(s) but will be reimbursed for mileage, postage, copying, or other expenses reasonably incurred by Consultant in the ordinary course of providing the Services. These sums have been included in the Contract Maximum.

7. Consultant will provide Consultant's own offices, equipment, phones, and other similar items for which Consultant will not be reimbursed by the Counties. From time to time, at the Counties' or TAC's sole discretion and for their own convenience, TAC or the Counties may provide Consultant with use of office space and support on a temporary basis without cost to Consultant.

8. Consultant shall submit detailed bills to TAC and the Counties not less frequently than the twentieth (20th) of each month for services rendered during the previous month. Such bills shall include hours worked, description by task of services for each charge and a detailed listing of all expenses, including copies of supporting invoices. Invoices shall be accompanied by a statement of percentage completion of the Services, broken down by task. Invoice copies to the TAC and Grand County may be submitted electronically; a hardcopy should be delivered to Jackson County as described in Para. 22 below.

9. It is understood that Consultant will have access to highly sensitive information and Consultant agrees to keep in confidence all information obtained in connection with performing the Services which is not publicly obtainable from other sources. Consultant will limit access to such information to those employees, agents and officers who require such information to assist in performance of the Services and will require that any person who has access to the information protect the confidentiality of the information pursuant to the terms hereof. Consultant will not use any information obtained in or as part of its performance under this Contract except in the performance of its duties hereunder. The provisions of this Paragraph 9 shall survive the Expiration Date or the termination of this Contract.

10. Consultant agrees to protect, indemnify, defend and hold the Counties, TAC and its members and participants and all of their respective officers, directors, shareholders, employees and agents harmless from and against all liabilities, claims, damages, losses, costs, damages, expenses (including but not limited to court costs and attorneys' fees), actions, suits, judgments and demands (including, but not limited to those attributable to bodily injury, sickness, disease, death or damages to or destruction of property resulting from or in any manner arising out of or in connection with the Services) arising out of or in any way relating to the negligence or willful misconduct of Consultant in performing the Services; provided that, Consultant shall not be liable to the Counties or TAC for losses, costs, damages, liabilities, expenses, actions, suits, judgments or demands resulting from the gross negligence or willful misconduct of the Counties and/or the TAC. If the Counties or TAC are forced to defend themselves or Consultant in a suit in any way relating to this Contract, Consultant agrees to cooperate in such defense as reasonably requested by the Counties or TAC. The provisions of this Paragraph 10 shall survive the Expiration Date or the termination of this Contract.

11. Consultant shall provide to TAC proof of insurance as described on Exhibit B to this Contract, which exhibit is incorporated herein by this reference, and maintain such insurances in full force and effect throughout the term of this Contract.

12. Subject to the provision for immediate termination of this Contract pursuant to the terms of paragraphs 1.b. above and 14 below, this Contract shall be terminable by the Counties at any time without cause by written notification of termination delivered thirty (30) days in advance of the date of termination. Upon such cancellation, neither party shall thereafter have any liability or responsibility to the other for the performance of, or payment for, any work hereunder, except that the Counties shall be liable for payment of all amounts properly due Consultant hereunder as of the date of such termination. .

13. Upon termination of this Contract by cancellation, expiration if its term or otherwise, as long as the Counties have paid all sums due to Consultant, Consultant shall be required to deliver to TAC all records, reports, data (including electronically or magnetically stored data) and other documents provided to or created by Consultant for use in connection with the Services. The provisions of this Paragraph 13 shall survive the Expiration Date or the termination of this Contract.

14. Consultant shall not have interests or obligations which conflict with Consultant's duty to advise and consult with TAC and/or the Counties on an independent basis with respect to the Services. When Consultant becomes aware of facts that do or could give rise to a conflict of interest with respect to its obligations created pursuant hereto, Consultant shall immediately notify the Counties and TAC and, after a good faith review of the conflict or potential conflict, the Counties may in their sole discretion terminate this Contract immediately upon notice in writing delivered to Consultant. Nor will Consultant oppose or offer its services to parties that oppose the efforts of TAC and/or the Counties either during the term of this Contract or for four (4) years thereafter. The agreement of Consultant not to oppose or offer its services to those who oppose the efforts of TAC and/or the Counties is material to this Contract and the Counties would not have entered into this Contract without it. The parties agree that damages for breach of the provisions of this Paragraph 14 are extremely difficult to quantify and that resulting damages will be irreparable. Consultant and the Counties further agree that the provisions of this Paragraph 14 shall be specifically enforceable by injunction or restraining order in addition to any other remedies the parties may have at law or in equity. The provisions of this Paragraph 14 shall survive the Expiration Date or the termination of this Agreement.

15. This Contract shall not be altered or amended except by writing signed by the party against whom enforcement of such alteration or amendment is sought. No "change orders" or alterations to the Services which would increase the Contract Maximum shall be permitted unless any such change is made as an amendment to this Contract and is signed by Grand and Jackson.

16. The failure of any party to exercise any contractual right or privilege hereunder, even if known to such party shall not be deemed a waiver of any such right or privilege or a waiver of any rights or remedies, present or future. Neither any failure nor any delay on the part of any party in exercising any right hereunder shall operate as a waiver; nor shall any single or partial exercise of any such right preclude any other or further exercise thereof.

17. The rights, duties and obligations of Consultant under this Contract may not be transferred or assigned without the prior written consent of Grand and Jackson.

18. Consultant and the Counties agree that this Contract is non-exclusive; Grand and Jackson, or either of them may obtain the Services from parties other than and in addition to Consultant, and Consultant may provide similar services to parties other than and in addition to the Counties and that Consultant will devote only a portion of Consultant's time to the interest of the Counties.

19.  This Contract shall be binding upon and inure to the benefit of the parties, as well as their respective successors, permitted assigns and legal representatives, as to any claim, cause of action, remedy or right of any kind.

20. This Contract may be executed in as many counterparts as is necessary, all of which, when taken together, will constitute a single Contract.

21. In the event any provision or clause of this Contract is determined to be illegal, unenforceable or in conflict with applicable law, such determination or conflict shall not affect the validity and enforceability of the other provisions of this Contract and to that end the provisions of this Contract are declared to be severable.

22. All notices and demands of any kind which either party to this Contract may serve upon the other under the terms of this Contract shall be in writing and shall be served upon the parties at the addresses set forth below by (a) personal delivery, including telecopy, e-mail or facsimile transmission, (b) by first class certified mail, return receipt requested, or (c) by a reliable private overnight delivery service which provides receipt of delivery and tracking of materials provided for delivery. If by personal delivery or Federal Express, service shall be deemed complete upon such delivery to the other party. If by mail, service shall be deemed complete three (3) days after mailing. The addresses, fax and e-mail numbers to which notices and demands shall be delivered or sent may be changed from time to time by written notice serviced by either party on the other as provided herein.

23. All parties represent and warrant to the other that they are legally free to enter into this Contract, that the execution hereof has been duly authorized and the terms and conditions of this Contract and each party's obligations hereunder do not conflict with or violate any terms or conditions of any other agreement or commitment to which such party is signatory or by which it is bound.

24. This Contract is the sole and complete statement of the obligations of the parties relating to the subject matter hereof and supersedes all previous understandings, agreements, negotiations and proposals as to this Contract. No provision of this Contract shall be deemed waived, amended or modified by any party unless such waiver, amendment or modification shall be in writing and signed by duly authorized officer of the party against whom the waiver or modification is sought to be enforced.

25. This Contract shall be governed and controlled by the substantive law of the State of Colorado without reference to any choice of law rules.

26. In the event of any action or proceeding to enforce the provisions of this Contract, the prevailing party shall recover its costs and expense as well as reasonable attorneys fees, arbitrator fees and expert witness fees, with such fees to be set by the judge or arbitrator and to be included in any award or judgment to be entered in such action or proceeding.

27. Venue for any litigation regarding or in any way related to this agreement shall be in Grand County, Colorado. Consultant agrees and submits to the personal jurisdiction of the District Court in Grand County for any given suit or action relating to or arising out of the terms of this Contract.

28. Consultant and the Counties agree that nothing in this Contract is intended to be and shall not operate as nor be construed as a waiver of the limits on monetary damages or any other rights, immunities or protections provided by the Colorado Governmental Immunity Act, CRS 24-10-101 et seq. as from time to time amended to the extent available to the Counties, TAC or their directors, participants, members, employees, agents, shareholders and/or officers.

29. a. In connection with performance of the Services, the Consultant shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin, age, marital status, being handicapped, a disadvantaged person, or a disabled or Vietnam era veteran, except where religion, sex or national origin is a bona fide occupational qualification reasonably necessary to the normal operation of the Consultant. The Consultant will take affirmative action to insure that applicants are employed without regard to their race, color, religion, sex, national origin, age, marital status being handicapped, a disadvantaged person, or a disabled or Vietnam era veteran. Such action shall include, but not be limited to the following: employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff, termination, rates of pay or other forms of compensation, and selection for training. The Consultant agrees to post in conspicuous places, available to employees and applicants for employment, notices setting forth the provisions of this nondiscrimination clause. The Consultant, in all solicitations or advertisements for employees placed by or on behalf of the Consultant, will state that such Consultant is an equal opportunity employer. Notices, advertisements and solicitations placed in accordance with federal law, rule or regulation shall be deemed sufficient for the purposes of meeting the requirements of this section. Upon request, Consultant will furnish to TAC all information and reports and will permit access to its books, records, and accounts by the TAC and the Counties for purposes of verification of compliance by Consultant with the provisions of this Paragraph 29.a.

b. In the event of the Consultant's noncompliance with the nondiscrimination provisions of this Contract, the Counties shall impose such contract sanctions as they may determine to be appropriate, including, but not limited to withholding of payments under this Contract until Consultant complies with such non-discrimination provisions, and/or cancellation, termination, or suspension of this Contract, in whole or in part.

30. In compliance with C.R.S. ß 8-17-101 and &102, preference shall be given to Colorado labor in the several classifications of skilled and common labor, and not less than eighty percent (80%) of each type or class of labor in the several classifications of skilled and common labor employed shall be Colorado labor. The term "Colorado labor" means any person who has been a bona fide resident of the State of Colorado for a period of not less than one (1) year, without discrimination as to race, creed, color, sex, age, national origin or handicap. Further, the Consultant shall make an affirmative effort to employ, where at all possible, qualified local (Grand County and Jackson County) labor as part of the work force used in performing the Services. Local sub-contractors must comply with union labor agreements to which the Consultant and/or its sub-contractors are bound, if any.

31. Consultant shall comply with all State and Federal laws and regulations in performance of the Services and, if requested by the TAC and/or the Counties, shall supply certification and evidence of such compliance.

32. Consultant represents and warrants that it has sufficiently informed itself in all matters affecting the performance of the Services and that the Contract Maximum is a complete and correct statement of Consultant's prices for performing the Services (including, but not limited to, all costs for labor, services, supplies, materials, equipment and other costs) set out in Tasks 1-9 on Exhibit A to this Contract.

This Transportation Development Program Consultant Contract between Grand and Jackson Counties and LSC Transportation Consultants is executed this 3rd day of February, 2000.

EXHIBIT A TO CONSULTANT CONTRACT

 

SCOPE OF WORK & PREPARATION OF

TRANSPORTATION DEVELOPMENT PROGRAM (TDP)

 

GRAND and JACKSON COUNTIES, COLORADO

 

 

CONSULTANT RESPONSIBILITIES

COUNTY/TAC RESPONSIBILITIES

 

TDP Task 1 - Study Administration and Organization

 

1. 1. Objective: to provide advice and guidance in regard to the development of a Transportation Development Program and to review its progress

 

2. Approach

 

a. The Consultant's services shall meet the following standard: "All workmanship in the performance of these services shall be of highest quality, and shall include the latest innovations and developments available."

 

b. The Consultant will timely provide the Transit Advisory Committee (TAC) with hard and e-copies of at least two technical memoranda (No. 1 after completion of Tasks 2-5; No. 2 after completion of Task 6) and a draft TDP for the review of the TAC in order to implement the specific goals and objectives for transit in the study area. The Consultant will meet with the TAC to review products of the TDP at key points and to obtain approve final products before the public comment period and/or distribution. One original, (40) hard copies and one e-copy (suitable for public website posting) of the draft TDP shall be delivered to the TAC by the Consultant not later than August 1, 2000. The Consultant shall post an electronic copy of the draft TDP on a publicly available website not later than August 1, 2000.

 

c. The Consultant will attend and make presentations at least eight (8) public comment meetings on the TDP; three (3) in various regions of Grand County and one (1) in Walden during the information-gathering process; and three (3) in various regions of Grand County and one (1) in Walden during the draft-to-final public comment period. The Grand County public meetings shall be held in Fraser/Winter Park, Granby, Grand Lake, Hot Sulphur Springs and Kremmling

 

d. The Consultant will conduct a day-long meeting with the TAC and interested members of the public at the initiation of the study to discuss the project goals, objectives, and issues. A second daylong meeting will be held by the Consultant and the TAC as part of developing and selecting transit alternatives as set out in Task #6 below. The TDP Consultant will also meet with the TAC following the submittal of the each Technical Memorandum and to present the recommendations contained in the draft TDP. These meetings will provide the opportunity for the TAC to provide guidance on the direction of the study and input as the project unfolds.

e. The Consultant shall assist the TAC and the staff of the Grand County Board of County Commissioners as needed in arranging for and publicizing TAC meetings, public comment meetings, meeting notices, agendas and materials, and compilation and distribution of minutes of meetings.

 

f. The Consultant will post the Technical Memoranda and Draft TDP on a web site so that this information may be easily accessed by any resident of or visitor to the Counties. The TAC and other interested persons will be able to contact the TDP Consultant by e-mail. The Consultant shall also provide to the TAC electronic copies suitable for posting on a publicly available website of the Technical Memoranda and the draft and final TDPs.

3. Product: The final product required of the Consultant, working in conjunction with the TAC, is a Transportation Development Plan (TDP) which meets the needs of residents/visitors of Grand and Jackson Counties, CDOT approval, Federal funding requirements and the suggestions of the Colorado Department of Highways (C-DOT) in How to Write a TDP: Guidelines for Rural and Small Urban Areas, Vol. 1, January 1990, and all applicable updates. The Consultant shall post a copy of all Technical Memoranda, all draft TDPs and the final TDP on a publicly available website and shall also provide electronic copies (suitable for website posting) of such documents to the TAC.

 

4. Personnel: Corinne Donahue, A.T.Stoddard, Felice Nida, Jim Charlier, Veronica Sommers and Gordon Shaw will be assigned by the Consultant to primarily complete the TDP in cooperation with the TAC.

 

5. Time to Complete: Ongoing, final TDP to be distributed by November 1, 2000.

 

TDP Task 1 - Study Administration and Organization

 

1. 1. Objective: to provide assistance and support necessary to the TDP consultant with regard to the development of the regional Transportation Development Program (Grand and Jackson Counties, Colorado) and reviewing its progress.

 

2. Approach

 

a. A Transit Advisory Committee (TAC), with representation from various geographical portions of the study area, local governments and school districts, transit providers and interested private citizens/employers has been formed. The members of the TAC were selected on the basis of expertise and/or geographical location so they can review and comment on what would work best in their area and for their needs in regard to the management and operation of a transportation program.

 

b. The TAC and its members, with the advice and assistance of the TDP Consultant, will establish the specific goals and objectives for transit in the study area and the TDP, and will meet regularly with the Consultant to review and comment on two technical memoranda and a draft TDP at key points. The TAC will approve the draft TDP before the public comment period, and the final TDP before distribution.

 

c. The Boards of County Commissioners will be responsible for arranging for publicizing and hosting TAC and public input/comment meetings, for publishing meeting notices, agendas and materials, and for compilation and distribution of minutes of meetings to all interested persons and TAC members.

 

d. The TAC and its members will provide additional administrative support to the Consultant in the form of: publicity, attendance at monthly TAC/Existing Transit Provider/Funding subcommittee meetings, arranging and hosting public input/comment meetings, making and covering the cost of long distance phone charges, traveling and travel expenses as needed to keep overall TDP Consultant costs low, publication layout and copying costs. The TAC will also provide and maintain a web-site upon which the TDP Consultant's technical memoranda and draft TDP reports may be posted for public comment.

 

e. The TAC and its members will provide professional support to the TDP Consultant and in anticipation of coordination of existing transit services and/or possible institution of new transit services in the study area by: attendance at and payment for professional training and conferences/seminars/ workshops suitable to establishing and funding region-wide and/or coordinated transit services;

 

f. The TAC and its members will provide technical support to the TDP Consultant via: GIS data gathering, analysis and transmission to TDP consultant; additional data collection (e.g. demographic updating of 1990 Federal census information); designing and conducting on-board ridership and/or funding surveys of existing transit services, written resident mail-in and/or newspaper and/or website surveys to establish transit demand vs. existing service; designing and conducting lodging surveys regarding transit needs and funding issues; distributing surveys and other data gathering and by providing data analysis to the extent possible.

 

g. A crucial element of the TDP study process will be frequent and open communication and coordination among the TAC, existing providers of transportation services,

agencies who rely on public transportation services, and the TDP Consultant. A close working relationship among the various parties will ensure a final product which best represents the views and interests of the local communities. The TAC may develop and regularly maintain a website accessible to residents of and visitors to the Counties for input of transit needs and concerns by the public. This web-site may also be used to survey residents and visitors on transit and transit funding issues and to receive public comment on the TDP Consultant's technical memoranda and the draft TDP. The TAC may post on such website copies of the two TDP Consultant Technical Memoranda and the draft TDP. Website comments received on these documents will be forwarded to and discussed with the TDP Consultant by the TAC. The TAC may post the final TDP on the website.

 

h. The members of the TAC will attend a daylong meeting with the TDP Consultant hosted by the TAC at the initiation of the study to discuss the project goals, objectives, and issues. The TAC will also meet with the TDP Consultant following the submittal of each Technical Memorandum and again to receive and decide upon the recommendations contained in the draft TDP. These meetings will provide the opportunity for the TAC to guide the TDP Consultant on the direction of the study and give input as the project unfolds.

i. As part of Task 6 below, the members of the TAC will also attend a daylong meeting with the TDP Consultant hosted by the TAC to review the two technical memoranda and to choose from master transit, coordination and funding alternatives presented in the draft TDP by the TDP Consultant.

j. The TAC and its members will provide labor and payment for other necessary support of the TDP process and the TAC's efforts to develop the highest quality implementable TDP for Grand and Jackson Counties.

3. Product: the TAC and its members provide an appropriate means to ensure that the development of the TDP addresses the concerns of the residents, visitors, officials and transit providers in the study area and that a logical CDOT/NWRPC-approved program for transit in the study area is produced.

 

4. Personnel: A Transit Advisory Committee (TAC) has been appointed for this project. The TAC consists to date of forty-five (45) private, professional, governmental and business members of the Grand and Jackson County communities. TAC work sessions and meetings are ongoing and are scheduled on a not-less-than monthly basis, allowing for technical and community representative input from a variety of sources as well as sustained communication with and guidance to the TDP Consultant, interested parties and the public.

 

5. Time to Complete: Ongoing. Implementable CDOT/NWRPC-approved final TDP to be distributed by November 1, 2000.

 

TDP Task 2 - Data Base Compilation

 

1. 1. Objective: to provide a demographic, geographic and socio-economic overview of the study area with projections covering the TDP planning periods.

 

2. Approach

 

a. The Consultant will review, coordinate and summarize existing local resources, federal census information, the resources of the state demographers and Colorado Department of Transportation and the office of the Grand and Jackson County Departments of Zoning and Planning to provide current demographic figures, six-year projections and nineteen-year projections. Consultant will propose and implement the most cost-effective mechanism/source for data gathering additional statistically reliable information. The Consultant will conduct key-person interviews of appropriate representatives of population segments in the study area.

 

b. If appropriate, the Consultant will assist the TAC and its members in designing and conducting additional surveys (on-board, lodging, resident, commuter, transit funding, etc.) in order to obtain data from all population segments in the study area. The Consultant will analyze any data gathered by the TAC and its members during such additional surveys and include any conclusions reached thereby in the TDP.

 

c. As part of this task the TDP Consultant will compile data from several comparable transit systems; for example, several transit systems from Colorado and Park City, Utah.

3. Products: The Consultant will produce Technical Memorandum No. 1: including updated, six-year and nineteen-year demographic and economic projection tables and distribution maps for inclusion in the TDP showing the following:

 

      a. general population

      b. population over 65 years

      c. minority populations

      d. persons with no automobiles

      e. handicapped population

      f. population below the poverty level

      g. elementary and secondary school students

      h. regional commuter patterns

      i. recreational visitors to Grand and Jackson Counties, by month and community

      j. activity centers including: resort/recreation areas, hospitals, clinics, senior centers, shopping centers and other commercial centers, schools, community colleges, and other transit generators

      k. major employment and recreation centers

      l. major housing centers, including locations of affordable and employee housing

       

4. Personnel: the Consultant will be responsible for the data compilation (and for directing the TAC as to additional surveys conducted by and at the expense of the TAC and its members) and for advising and directing the TAC as to additional information which can be readily gathered by its members to assist the TDP Consultant in completing Task No. 2. The Consultant will be responsible for the data analysis, graphics and shall provide to the TAC one original, an electronic copy (suitable for public website posting) and twenty-five (25) hard copies of Technical Memorandum No. 1 covering Tasks 2-5. The Consultant shall also post a copy of Technical Memorandum No. 1 on a publicly available website.

 

TDP Task 2 - Data Base Compilation

 

1. 1. Objective: to research and provide an updated, transit-specific demographic, geographic and socio-economic overview of the study area with projections covering the TDP planning periods.

 

2. Approach

a. The TAC and its members will assist the TDP Consultant in researching and gathering data preparatory to analyzing unmet transit needs and possible solutions in the study area.

 

b. TAC members WPRA, Silver Creek Holdings and YMCA/Snow Mountain Ranch will conduct transit needs research via ridership, transit funding and/or lodging surveys during February-June 2000 time period, with the assistance of the TAC and the TDP consultant.

 

c. The TAC may develop and regularly maintain a web-site accessible to residents of and visitors to the Counties for input of transit needs and concerns by the public. This web-site may also be used to survey residents and visitors on transit issues, transit funding issues and to receive public comment on the TDP Consultant's technical memoranda and the draft TDP.

 

d. The TAC will provide to the TDP consultant copies of the following existing background information and research:

 

        1) Grand County TDP (1986-1990);

        2) Grand County Specialized TDP, Elderly & Handicapped (1991-1996);

        3) The draft Northwest Colorado 2020 Transportation Plan;

        4) The Grand County Master [Growth] Plan (April 1998;

        5) Grand County Lifestyles: Summary of Results of Surveys,

        6) Focus Groups & Public Records Gathered 1991-1995;

        7) Fox Run Apartments Market Study;

        8) Summit County TDP Update 2000-2005 (June 1999);

With the input of the TAC, the TDP Consultant will prepare its Technical Memorandum No. 1 (covering Tasks 2-5) which memorandum the TAC may post on a publicly available website for comment. The TAC shall review Technical Memorandum No. 1 and provide comments to the TDP Consultant. The TAC shall forward public comments received to the TDP Consultant.

 

4. Personnel: The TAC and its members will assist the Consultant in gathering additional research and public comment.

 

TDP Task 3 - Transit Demand Update and Needs Estimation

 

1. Objective: to define and estimate the need for transit by the various population segments in, to and from Grand and Jackson Counties.

 

2. Approach

 

a. the Consultant will develop unmet six- and nineteen-year transit demand estimates by

 

    1) reviewing, refining and updating existing resources,

     

    2) conducting key person interviews of residents, regional commuters and visitors,

     

    3) analyzing data obtained via additional surveys conducted by the TAC and its members; and

     

    4) facilitating the receipt of public input at three (3) public meetings held in various regions of Grand County and one (1) public meeting held in Walden, Colorado.

     

b. the service supplied as tabulated in Task #5 will be

compared with the demand calculated in this task to determine whether unmet needs exist.

 

3. Products:

 

a. The Consultant will provide a quantitative transit needs chart and text discussion for the various population segments, visitors and the general public (See Task 2; ß 3.a-l above) in the study area; this profile will indicate percent of unmet need of the various geographic portions of Grand and Jackson Counties about patterns, times and sites of transit demand (including intercity bus and regional commuter services). Public transit trip purposes and times of transit demand shall also be addressed.

 

b. The Consultant will generate maps

 

    1) identifying heavy, intermediate and light resident/regional commuter travel patterns (i) within Grand County and Jackson County and (ii) connected with regions outside Grand County and Jackson County;

     

    2) identifying heavy, intermediate and light visitor travel patterns (I) within Grand County and Jackson County and (ii) connected with regions outside Grand County and Jackson County;

     

    3) indicating total annual and monthly transit needs by community within Grand County and within Jackson County.

     

c. The Consultant will include this information in its Technical Memorandum No. 1. The Consultant will prepare, provide to the TAC one original, an electronic copy (suitable for website posting) of and distribute twenty-five (25) hard copies of its Technical Memorandum No. 1. The Consultant shall also post a copy of Technical Memorandum No. 1 on a publicly available website.

 

 

 

4. Personnel: the Consultant will conduct the key-person interviews, analyze additional survey information and other data, and will develop the quantitative needs estimates and qualitative transit demand text discussions and map(s) with the assistance of the TAC and its members; the Boards of County Commissioners will arrange for, publicize and host the four (4) public comment/input meetings on transit needs. The TDP Consultant will prepare and post on a publicly available website its Technical Memorandum No. 1.

 

TDP Task 3 - Transit Demand Update and Needs Estimation

 

1. Objective: to define and estimate the need for transit by the various population segments in, to and from Grand and Jackson Counties.

 

2. Approach

 

a. The TAC and its members will assist the TDP Consultant in gathering research data, identifying appropriate key-persons for interview by the Consultant, and by designing and conducting appropriate additional transit and/or transit funding surveys of study area residents, commuters and visitors.

 

b. The TAC and its members will arrange for, publicize and host the four public meetings in the study area to obtain public input/comment about transit needs and the acceptability of alternative solutions.

 

c. The TAC and its members will provide technical support to the TDP Consultant via GIS data gathering, analysis and transmission to TDP consultant for inclusion in its maps produced as part of this Task.

 

3. Products:

 

a. The TAC and its members will assist the TDP Consultant gather the underlying public data (in four public meetings, by identifying key-persons for interviews, and/or by designing and conducting additional surveys and otherwise) to support the Consultants' analysis of transit needs and unmet demand for the various population segments in the study area and production of the TDP Consultant's Technical Memorandum No. 1.

 

b. The TAC may develop and regularly maintain a web-site accessible to residents of and visitors to the Counties for input of transit needs and concerns by the public. This website may also be used to survey residents and visitors on transit and transit funding issues and to receive public comment on the TDP Consultant's technical memoranda and the draft TDP.

 

c. With the input of the TAC, the TDP Consultant will prepare its Technical Memorandum No. 1 (covering Tasks 2-5) which memorandum the TAC may post on a publicly available website for comment. The TAC shall forward public comments received to the TDP Consultant.

 

d. The TAC shall review Technical Memorandum No. 1 and provide comments to the TDP Consultant.

 

4. Personnel: The TAC and its members will assist the Consultant in gathering additional information and/or will prepare, publish, design and conduct additional surveys focused on transportation issues as needed and as assisted by the Consultant. The TAC may post and receive comments on the TDP Consultant's Technical Memorandum No. 1 on a publicly available website.

 

TDP Task 4 - Inventory of Transit Providers

 

1. Objective: to provide an inventory of public and private transit services presently offered within the study area, including intercity bus services, and to provide information necessary for subsequent tasks including identifying possibilities for enhanced service and/or reduced cost by coordinating existing transit services; to obtain information on operational statistics, expense and funding sources and organizational structure.

 

2. Approach

 

a. The Consultant will identify the categories of Information will be to be collected from existing transit providers within the study area including public and private transit operators, specialized E&H providers, intercity bus operators, taxis, lodge shuttles, nursing home transportation, and others involved in transit and paratransit.

 

    1) Such information categories shall include trip origins, destination, purpose and transfer patterns as well as interest in and ability to coordinate transit activities in the areas set forth in Task 5, ß2.b.6. below.

     

b. The Consultant will update the previous Grand County TDP existing provider information.

 

c. the format for the inventory will be a table with the following information by geographic region within Grand County and Jackson County for each transit provider. (including financial information for private providers to the extent they are willing to provide it);

 

        1) name of operation and type of service (fixed route, demand responsive, etc.)

        2) service area(s) and primary type of clients served

        3) time and level of service

        4) hours of operation

        5) miles of operation

        6) number of passenger trips

        7) number of passengers served

        8) number of vehicles and routes

        9) seating capacity and vehicle equipment

        10) vehicle mileages and expected replacement year

        11) annual operating, administrative and capital expenditures

        12) fare schedule: adult, elderly, handicapped, student, visitor

        13) employees: admin., drivers, maintenance, other

        14) sources of revenue and type of ownership

         

d. The Consultant will spend time riding each of the existing transit services to become familiar with the systems and to observe the daily operations.

3. Products:

 

a. The Consultant shall produce a table showing the above information with annual and monthly totals for each provider showing the following data items:

 

    1) total trips

    2) total vehicle miles

    3) total vehicle hours of operation

     

     

    4) total revenues

    5) total expenditures

    6) total passengers served

    7) trips per passenger

    8) trips per vehicle mile

    9) trips per vehicle hour

    10) cost per trip

    11) cost per vehicle mile

    12) cost per vehicle hour

     

b. The Consultant shall prepare tables and maps indicating annual and monthly existing transit provided by geographic sub-region/community within Grand County and Jackson County.

 

c. The Consultant will prepare a summary of their observations made while riding existing transit services and shall use the information to develop potential alternatives.

d. The Consultant will include this information in their Technical Memorandum No. 1. The Consultant will prepare, provide to the TAC one original, an electronic copy (suitable for website posting) of and distribute twenty-five (25) hard copies of its Technical Memorandum No. 1 covering Tasks 2-5. The Consultant shall post a copy of Technical Memorandum No. 1 on a publicly available website.

 

4. Personnel

a. The Consultant will identify the information categories for the inventory to be obtained by the TAC from existing transit providers.

 

b. the Consultant will become familiar with the existing transit services in the study area and will review and analyze the inventory and then provide the recommendations for transit alternatives and coordination of existing transit services to reduce duplication and costs and to increase efficiencies.

 

TDP Task 4 - Inventory of Transit Providers

 

1. Objective: to provide an inventory of public and private transit services presently offered within the study area, including intercity bus services, and to provide information necessary for subsequent tasks including identifying possibilities for enhanced service and/or reduced cost by coordinating existing transit services; to obtain information on operational statistics, expense and funding sources and organizational structure.

 

2. Approach

 

a. The TAC and its members, working through the Existing Transit Provider Subcommittee, will collect and transfer to the Consultant the inventory information in the identified categories regarding existing transit services/providers in the study area.

 

3. Products:

 

a. The TAC will provide input to the TDP Consultant in producing a study included in the TDP Consultant's Technical Memorandum No. 1 outlining the management, operations, capital requirements and economic feasibility of existing transit services in Grand and Jackson Counties to be incorporated in the TDP.

 

b. The members of the TAC Existing Transit Provider Subcommittee will meet regularly. In consultation with the TDP Consultant this Subcommittee will develop and explore coordination possibilities in at least the following areas:

 

    1) service information

    2) vehicle maintenance

    3) purchase of parts and supplies

    4) purchase of insurance

    5) interagency contracting

    6) vehicle sharing

    7) driver training and safety

    8) accounting and bookkeeping services

    9) computer sharing

     

c. The TAC will identify for the TDP Consultant appropriate divisions of the study area into geographic sub-regions.

 

d. With the input of the TAC, the TDP Consultant will prepare its Technical Memorandum No. 1 (covering Tasks 2-5) which memorandum the TAC may post on a publicly available website for comment.

 

e. The TAC shall review Technical Memorandum No. 1 and provide comments to the TDP Consultant. The TAC shall discuss public comments received with the TDP Consultant.

 

4. Personnel: The TAC, its members and subcommittees will gather the necessary information, supplement such information as needed and assist the TDP Consultant in studying existing transit services/providers and coordination possibilities in the manner described.

 

TDP Task 5 - Evaluation of Existing Service vs. Transit Needs

 

1. Objective: to determine the extent to which the need for transit service in the study area is being met and from this evaluation to design more efficient/cost effective alternatives to meet these needs and any unmet needs.

 

2. Approach

 

a. The Consultant will evaluate existing transit services using the guidelines below; The tables and maps prepared by the for Tasks #3 and #4 can be the source of much of this information.

 

b. transit supply and condition & The Consultant will prepare a narrative description of the current status of transportation in the study area, discussing at least the following elements:

 

    1) quality and quantity of service based on service hours, service miles and area coverage,

     

    2) efficiency of service provided based on cost of service.

     

    3) effectiveness of service based on percent of demand being met as well as how well services meets transit goals and objectives.

     

    4) evaluating local support including the amount of financial support provided by the local governments and taxpayers, private entities, as well as volunteer help and community support

     

    5) evaluating management, financing and institutional arrangements of existing transit providers, which should be divided into the following categories:

     

    a) administrative responsibilities: include analysis of current sources of transportation funding, eligibility to continue receipt of these funds and procedures required to secure them; grant writing; capital acquisition and financing of equipment and support facilities: service monitoring and reporting: service change decisions; accounting and budgeting; insurance; and public information and marketing.

     

    b) Operating responsibilities: management and supervision of services; scheduling of routes, vehicles, and drivers; vehicle maintenance; parts purchases; driver training; and safety inspection.

     

    6) Suggesting possible coordination of existing transit activities: providing an evaluation of the extent of coordination of transit service in the study area and specific future coordination recommendations including:

     

    a) service information

    b) vehicle maintenance

    c) purchase of parts and supplies

    d) purchase of insurance

    e) interagency contracting

    f) vehicle sharing

    g) driver training and safety

    h) accounting and bookkeeping services

    i) computer sharing

 

3. Products:

 

a. the Consultant will prepare a narrative working paper, Technical Memorandum No. 1, identifying deficiencies and duplications in existing service, clarifying service need and suggesting implementable coordination activities for existing transit providers.

 

b. The Consultant shall publish the results of tasks 2-5 in Technical Memorandum No. 1, one original, an electronic copy (suitable for website posting) and twenty-five (25) hardcopies of which will be provided to the TAC. The Consultant shall post a copy of Technical Memorandum No. 1 on a publicly available website.

 

4. Personnel: the Consultant will prepare the evaluation and recommendations of Technical Memorandum No. 1 with the aid of the Existing Transit Provider Subcommittee of the TAC.

 

TDP Task 5 - Evaluation of Existing Service vs. Transit Needs

 

1. Objective: to determine the extent to which the need for transit service in the study area is being met and from this evaluation to design more efficient/cost effective alternatives to meet these needs and any unmet needs.

 

2. Approach

 

a. The Existing Transit Provider subcommittee of the TAC will assist the Consultant in analyzing the data obtained from the inventory in Task No. 5, evaluating unmet transit demand and in designing implementable coordination possibilities between existing transit providers.

 

3. Products:

 

a. A comprehensive analysis of existing transit providers/services in Grand and Jackson Counties in the categories specified.

 

b. A thorough understanding of whether existing transit services/providers meet existing demand and, if not, where and when unmet transit demand exists.

 

c. Specific implementable recommendations for coordination of existing transit services/providers in the following areas:

 

    1) service information

    2) vehicle maintenance

    3) purchase of parts and supplies

    4) purchase of insurance

    5) interagency contracting

    6) vehicle sharing

    7) driver training and safety

    8) accounting and bookkeeping services

    9) computer sharing

     

     

d. With the input of the TAC, the TDP Consultant will prepare its Technical Memorandum No. 1 (covering Tasks 2-5) which memorandum the TAC may post on a publicly available website for comment.

 

e. The TAC shall review Technical Memorandum No. 1 and provide comments to the TDP Consultant. The TAC shall discuss public comments received with the TDP Consultant.

 

4. Personnel: The TAC's Existing Transit Provider subcommittee will assist the TDP Consultant in gathering data, analyzing efficiencies and developing implementable coordination possibilities between existing transit services/providers.

 

TDP Task 6 - Development of Master Transit Plan and Alternatives for Improvement of Service

 

1. Objective: to make recommendations for specific development of six-year and general development of nineteen-year transit service programs to meet transit needs in Grand County in the most effective and efficient way within available and/or readily obtainable resources.

 

2. Approach

 

a. The Consultant will examine the data compiled in the evaluation tasks above to determine where the existing Grand and Jackson County transit services do not meet needs or is ineffective or inefficient

 

b. the Consultant will use the evaluation tasks to examine alternatives or improvements to bring about a desired level of service and efficiency.

 

c. The Consultant will identify recommended institution, expansion and/or improvements of/to transit services in/to/from Grand County and Jackson County, including Intercity Bus and Regional Commuter Service alternatives

 

d. The Consultant will analyze funding structure: who pays vs. who benefits from the current arrangement, generate alternative future funding structures with appropriate cost/benefit analysis

 

e. The Consultant will review needs/opportunities/cost/benefit of individual community transit systems, if existing and/or if recommended

 

f. The Consultant will present a day-long workshop in Grand County, again with the TAC and other interested persons participating, to develop the specific alternatives. During the workshop, descriptions of the alternatives will be developed. Each of the following components will be incorporated into a cost-effectiveness analysis for the alternatives. The alternatives will also be evaluated based on the goals and objectives for transit service in the region. The descriptive information provided to the TAC by the Consultant will include:

        1. Type of service to be offered;

        2. Operating characteristics, including service areas, routes and schedules, hours of operation, vehicle mileage, etc.;

        3. Provisions for meeting elderly and disabled needs,

        4. recommended management structures and their justification

        5. Estimates of ridership;

        6. Financial characteristics including operating, capital and administrative costs, fare, charter, advertising, tax, and other revenues;

        7. Legal considerations including institutional structure and constraints;

        8. Equipment needs including a capital equipment plan showing equipment to be purchased for each of the six years;

        9. Projected vehicle mileage and the potential for rehabilitating vehicles prior to new purchases.

3. Products: (in order of priority and emphasis)

 

a. Six-Year Implementation of County-wide Wheeled Transit Service. The Consultant will create a specific implementable working paper setting forth, in detail, recommended county-wide wheeled six-year transit services based upon the evaluation tasks above. The Consultant will provide text, tables and estimated financial requirements discussing their recommended six-year transit service plan including:

 

        1) service area(s) and primary type of clients served

        2) time and level of service

        3) hours of operation

        4) miles of operation

        5) number of passenger trips

        6) number of vehicles and routes

        7) seating capacity and vehicle equipment, with a summary environmental assessment and cost/benefit analysis of fuel alternatives (gas, diesel, electric, propane, etc.)

        8) annual operating, administrative and capital expenditures

        9) fare schedule: adult, elderly, handicapped, student, visitor

        10) number of employees: admin., drivers, maintenance, other

        11) funding/revenue sources (private v. public v. mixed public/private, etc.), analyzing the pros, cons and public acceptability of each

        12) organizational structure (authority v. district, etc.)

        13) recommend a financial structure and plan to meet all capital and operating funding requirements for the initial six-year period, including a budget schedule (see Task #7).

         

The Consultant's discussion and/or tables should show the resources needed (budgeting and financing method) to institute county-wide transit services, thus allowing the TAC to select alternatives that meet County transportation goals and objectives, is operationally and institutionally feasible, and is implementable within existing citizen and public/private entity support. (See Task #8)

 

b. Discussion of Staged Nineteen-Year All-Modality Transit Recommendations. The Consultant will create and discuss a recommended staged nineteen-year development [vision] of transit opportunities in Grand County and Jackson County in all modalities. The stages should include at least: (1) six-year wheeled transit implementation period including planning & publicity, (2) investigation and maturation of short- and long-term all modality transit service, (3) review/enhancement of short- and long-term transit plans.

c. Coordination Plan for Existing Transit Service/Providers. The Consultant will provide a narrative discussion of recommended alternatives detailing coordination possibilities for existing transit services (and, if savings is realized, recommending expansion of transit service using existing transit providers) in the study area. The Consultant will provide tables showing the resources needed (budgeting and financing method) to institute each alternative (and any possible expansion) using the categories of Task 6 ß3.a.1-13 above and Task #7, ß2.g.1-7 below, thus allowing the TAC to select an alternative that meets County transportation goals and objectives, is operationally and institutionally feasible and implementable within existing resources. (This product should be able to ëstand alone' whether or not six- and/or nineteen-year county-wide transit recommendations are implemented.)

d. Planning/Zoning Recommendations To Enhance Implementation of Transit Alternatives. The Consultant will suggest particular enhancements, if recommended, to existing county and municipal zoning and land use planning, including by examining the impact of land use decisions on transportation needs and the exploring opportunities for preservation of transportation corridors.

 

e. The Consultant shall publish the results of tasks 2-5, 6 & 8 in Technical Memorandum No. 2, one original, one electronic copy (suitable for website posting) and forty (40) hardcopies of which will be provided to the TAC. The Consultant shall also post a copy of Technical Memorandum No. 2 on a publicly available website.

 

4. Personnel: Formulating the recommendations of these tasks and preparation of Technical Memorandum No. 2 will be the responsibility of the Consultant; the selection of recommended alternatives will be the responsibility of the Transit Advisory Committee and/or its voting members either individually or collectively.

 

TDP Task 6 - Development of Master Transit Plan and Alternatives for Improvement of Service

 

1. Objective: to make recommendations for specific development of six-year and general development of nineteen-year transit service programs to meet transit needs in Grand and Jackson Counties in the most effective and efficient way within available and/or readily obtainable resources.

 

2. Approach

 

a. The TAC, its members and subcommittee will provide information to the TDP Consultant to aid in its analysis of appropriate, implementable planning recommendations for: (a) six-year wheeled county-wide transit plan(s); (b) nineteen-year all-modality transit plan(s); (c) coordination recommendations between existing transit providers; and (d) zoning and land-use planning improvements relative to transportation issues.

 

b. The TAC members will attend such professional training and conferences/seminars/workshops as are suitable to aid Grand and Jackson Counties in establishing, managing and operating county-wide and/or coordinated transit services, and thereby implementing the final TDP;

 

c. During a day-long workshop in Grand County hosted by the TAC, the TAC, its members, subcommittees and other interested persons will provide input to the TDP Consultant to aid in its options evaluation and development of alternatives for Grand and Jackson County transit service management, operations, funding acceptability, capital requirements and economic feasibility.

 

 

d. The TAC, its members and subcommittees will select the most viable, publicly supported alternatives from the planning options generated by the TDP Consultant.

 

3. Products:

 

a. Implementable, publicly supportable, draft:

 

    1) six-year wheeled county-wide transit plan(s);

     

    2) nineteen-year all-modality transit plan(s);

     

    3) coordination plan/recommendations between existing transit providers; and

     

    4) recommended zoning and land-use planning improvements relative to transportation issues.

     

b. With the input of the TAC, the TDP Consultant will prepare its Technical Memorandum No. 2 (covering Tasks 2-5, 6 and 8) which memorandum the TAC may post on a publicly available website for comment.

 

c. The TAC shall review Technical Memorandum No. 2 and provide comments to the TDP Consultant. The TAC shall discuss public comments received with the TDP Consultant.

 

4. Personnel: Formulating the recommendations will be the responsibility of the Consultant; the selection of recommended alternative plan(s) and the gaining of all necessary training and/or hiring of necessary personnel to implement such alternatives will be the responsibility of the TAC.

 

TDP Task 7 & Operation and Management

 

1. Objective: to provide a program for implementation of (a) the six-year (2001 & 2007) TDP recommendations, and (b) the existing service coordination recommendations, and (c) adequate data for redefining each of these alternatives as appropriate.

 

2. Approach: the TDP Consultant will develop:

 

      a. map(s) indicating areas to be served and types of transit service needed

      b. a monitoring program to track performance measures

      c. an organizational/management chart

      d. a chart of coordination activities

      e. an analysis of privatization activities

      f. a six-year financial plan for implementation of a county-wide transit system containing:

        1) operating expenses

        2) administrative expenses

        3) capital expenses

        4) expected revenue and sources of revenue (emphasis should be on less dependence on funds generating by additional taxes)

        5) a marketing program

         

      g. specific recommendations for coordination of Existing Transit Services including :

       

        1) service formation

        2) vehicle maintenance

        3) vehicle sharing

        4) purchase of parts and supplies

        5) purchase of insurance

        6) inter-entity contracting

        7) driver training and safety

         

3. Products:

 

a. The Consultant will prepare a detailed plan which can implement and guide county-wide wheeled transit service operations in/to/from Grand County for the next six years (2001-2007),

 

b. The Consultant will prepare a nineteen-year conceptual plan which can form the basis for development of Grand County transit opportunities in all modalities over that time period (2001-2020); and

 

c. The Consultant will generate specific recommendations for coordinating existing transit services to reduce inefficiencies and realize costs savings (and, if savings are thereby realized, recommending service expansions) either while the six-year and/or nineteen year transit plans are implemented and/or if either plan is not implemented.

 

d. At the end of this task the Consultant will prepare and provide to the TAC one original, fifty (50) hardcopies and one electronic copy (suitable for website posting) of the draft TDP. The Consultant shall also post a copy of the draft TDP on a publicly available website.

 

e. The Consultant will submit the draft TDP not later than August 1, 2000 providing the TAC, its members and the general public a second opportunity to comment on revisions made to previous work and review the detailed Operations Program before a Final TDP is printed. The Consultant will attend a TAC meeting to discuss this draft TDP and receive comments.

4. Personnel: the primary responsibility will rest with the Consultant.

 

a) the Consultant will work very closely with the TAC on this aspect of the study; the TAC members will review and comment on what would work best in their communities/constituencies and for their needs in regard to the management and operation of a transportation program, coordination of existing transit services/providers and a long term vision for all-modality transportation in Grand and Jackson Counties.

 

TDP Task 7 & Operation and Management

 

1. Objective: to provide a program for implementation of (a) the six-year (2001 & 2007) TDP recommendations, and (b) the existing service coordination recommendations, and (c) adequate data for redefining each alternative as appropriate.

 

2. Approach:

 

a. Building upon the discussions and ideas developed in the day-long workshop of Task No. 6, the TAC and its members will select among alternatives presented by the TDP Consultant for a (a) six-year wheeled transit plan, (b) a coordination plan to increase efficiencies and reduce duplications among existing transit providers and (c) a nineteen-year conceptualized all-modality transportation plan in the Counties. The TAC will provide regular feedback and direction to the TDP Consultant as it develops specific management, operations, capital/systems, funding, marking and monitoring projections for the six-year wheeled transit plan.

 

b. With the assistance of the TAC, the TDP Consultant will prepare its Draft TDP (covering Tasks 2-8) which document the TAC may post on a publicly available website for comment.

 

c. The TAC and its members will comment upon the draft TDP prepared by the Consultant at the completion of Task No. 7. The TAC will forward to the Consultant all public comments received on the draft TDP.

 

3. Products:

 

a. Implementable, fundable draft TDP options to present for public discussion during the public comment/input and review period.

 

4. Personnel:

 

a. The TAC will arrange for and host the four (4) public comment/input meetings in Grand and Jackson Counties, will provide input to the TDP Consultant on the draft TDP and will take all other necessary action which will result in the highest quality implementable, fundable TDP(s) for Grand and Jackson Counties.

 

b. The TAC will work very closely with the TDP Consultant on this aspect of the study; the TAC members will review and comment on what would work best in their communities/constituencies and for their needs in regard to the management and operation of a transportation program, coordination of existing transit services/providers and a long term vision for all-modality transportation in Grand and Jackson Counties

 

TDP Task #8 - Funding Source Analysis and Recommendation

 

1. Objective: to provide a comprehensive discussion and analysis of the advantages and disadvantages of various funding options for implementation of the six-year TDP recommendations and nineteen-year TDP conceptualization.

 

2. Approach:

 

a. The TDP Consultant will research and evaluate long- and short-term private and public funding options including those available for initial capital expenditures and ongoing operating funds.

 

b. The TDP Consultant will evaluate the feasibility/advisability of bus/busstop advertising and rider fares as funding sources.

 

c. Through key-person interviews (and surveys as necessary and/or appropriate) of Grand and Jackson County residents and visitors (see population groups set out in Task 2; ß 3.a-l above, the TDP Consultant will determine which funding options are most implementable and address the concerns of fairness in different communities of Grand and Jackson Counties.

 

d. As part of this task, the Consultant will facilitate community dialogue on the need for a long-term, sustainable and equitable funding system for public transit

in Grand and Jackson Counties, and through this dialogue determine public support for various funding options. This dialogue will consist of discussions at the public meetings, discussions at a Transit Advisory Committee meeting, and structured interviews with key persons.

 

3. Products:

 

a. The Consultant will prepare a chart setting out funding options analyzed by:

 

    1) existing public and private dollars available,

     

    2) identifying additional public and private funding available or expected to be available, purposes for which additional funding is/will be available (e.g. less polluting mass transit vehicles), length of time/difficulty to obtain, major funding pre-requisites, funding cycle deadlines; and

     

    3) public acceptability of each option.

     

b. The Consultant will discuss in its Technical Memorandum No. 2 future and/or additional funding sources by ranking on a continuum with the most preferred alternative being that which will provide efficient, equitable funding sources for transit services in Grand County and Jackson County that will have greatest likely resident and visitor support in ridership.

 

c. The Consultant shall publish the results of tasks 2-5, 6 & 8 in Technical Memorandum No. 2, one original, one electronic copy (suitable for public website posting) and forty (40) hardcopies of which will be provided to the TAC.

 

d. The Consultant shall also post a copy of Technical Memorandum No. 2 on a publicly available website.

 

4. Personnel: The Consultant will have primary responsibility for this task, in consultation with the Funding subcommittee of the TAC.

 

TDP Task #8 - Funding Source Analysis and Recommendation

 

1. Objective: to provide a comprehensive discussion and analysis of the advantages and disadvantages of various funding options for implementation of the six-year TDP recommendations and nineteen-year TDP conceptualization.

 

2. Approach

 

a. With the funding options and alternatives produced by the Consultant, the TAC and its members, working through its Funding Subcommittee, will explore the viability and public acceptability of transit funding in Grand and Jackson Counties.

 

b. The TAC's Funding Subcommittee will then rank all viable funding options on a continuum of implementability with the most preferred alternative being that which will provide efficient, equitable funding sources for transit services in Grand County and Jackson County and that will have greatest likely resident and visitor funding and ridership support.

 

3. Products:

 

a. Specific, publicly acceptable funding options for:

 

    1) the recommended six-year wheeled county-wide transit plan(s);

     

    2) the nineteen-year all-modality transit plan(s) vision;

     

b. The TAC members will attend such professional training and conferences/seminars/workshops as are suitable to aid Grand and Jackson Counties in funding county-wide and/or coordinated transit services, and thereby implementing the final TDP.

 

c. The TAC may develop and maintain a web-site accessible to residents of and visitors to the Counties for input of transit needs and concerns by the public. This web-site may also be used to survey residents and visitors on transit funding issues.

 

d. The TAC and its members will assist the TDP Consultant in gathering research data, identifying appropriate key-persons for interview by the Consultant, and/or by designing and conducting appropriate additional surveys of study area residents, commuters and visitors on transit funding issues.

 

e. With the assistance of the TAC, the TDP Consultant will prepare its Technical Memorandum No. 2 (covering Tasks 2-5, 6 and 8) which memorandum the TAC may post on a publicly available website for comment.

 

4. Personnel: The Funding Subcommittee of the TAC will assist the TDP Consultant in gathering funding issue data, in evaluating the funding alternatives presented by the TDP Consultant and by ranking such alternatives on a continuum on the specified criteria. The TAC shall review Technical Memorandum No. 2 and provide comments to the TDP Consultant.

 

TDP Task 9 - Completion and Distribution

 

1. Objective: to receive input from the TAC, the Grand and Jackson County Boards of County Commissioners, Colorado Department of Transportation (CDOT), Northwest Regional Transportation Planning Commission (NWRPC), the public and others regarding the acceptability of the document as an implementable transportation development program.

 

2. Approach:

 

a. by August 1, 2000 the Consultant will distribute a draft of the TDP to all concerned parties including CDOT. The Consultant will be responsible for printing one original and fifty (50) copies of the draft document; the staff of the Grand and Jackson County Boards of County Commissioners will be responsible for posting at least one (1) copy of the draft document in a public place in each community in Grand and Jackson Counties. The Consultant will also provide to the TAC by August 1, 2000 an electronic copy of the draft TDP suitable for posting on a public website and shall also post such draft TDP on a publicly available website.

 

b. The Consultant will receive input from the Counties and the members of the TAC both in writing and at a TAC work meeting between August 1-30, 2000.

 

c. The Consultant will receive public input regarding the draft document in writing and at four (4) (three in Grand County; one in Walden) public meetings (see Task #1, 2.c. for meeting places) between August 1, 2000 and September 30, 2000.

 

d. The Consultant will deliver to CDOT and the NWRPC a copy of the draft TDP for their review and comment.

 

e. After review and approval of the draft TDP, the Consultant will prepare final illustrated report. The Final TDP will include all of the work accomplished in Tasks 1 through 8, and will detail the recommended plans intended for adoption.

3. Products: The Consultant will revise the draft TDP and print and distribute a final TDP by November 1, 2000. The Consultant will print sixty-five (65) hardcopy originals of the final TDP document. The Consultant will provide an electronic copy (suitable for posting on a public website) of the final TDP. The camera-ready artwork incorporated in the final TDP will be delivered to the TAC with the final document. The Consultant shall also post a copy of the final TDP on a publicly available website.

 

4. Personnel: the Consultant and the TAC will accomplish this activity with the Consultant completing all necessary revisions and publishing and distributing the final TDP.

 

TDP Task 9 & Completion and Distribution

 

1. Objective: to receive input from the Transit Advisory Committee, the Grand and Jackson County Boards of County Commissioners, Colorado Department of Transportation (CDOT), Northwest Regional Transportation Planning Commission (NWRPC), other government entities, the public and others regarding the acceptability of the document as an implementable transportation development program.

 

2. Approach:

 

a. The TAC, its members and subcommittees will review all technical memoranda and draft documents and provide comments and suggested revisions to the Consultant not later than August 30, 2000.

 

b. The TAC and/or its members will arrange for, host, publicize and conduct four public meetings (three in Grand County, one in Walden) by September 30, 2000 to receive public input on the draft TDP.

 

c. The TAC and/or its members will post at least one (1) hardcopy of the draft TDP in a public place in each community in Grand and Jackson County.

 

d. The TAC and/or its members will publicize any website at which the draft TDP may be reviewed and the TDP Consultant's address and e-mail address at which written comments on the draft TDP will be received.

 

e. The TAC may develop and regularly maintain a website accessible to residents of and visitors to the Counties for input of transit needs and concerns by the public. This web-site may also be used to receive public comment on the TDP Consultant's technical memoranda and the draft and final TDPs. The TAC may post on such website copies of the two TDP Consultant Technical Memoranda and the draft TDP. Website comments received on these documents will be forwarded to and discussed with the TDP Consultant by the TAC. The TAC may also post the final TDP on the website.

 

3. Products: By November 1, 2000 final, implementable, fundable, publicly acceptable Transportation Development Program(s) will have been developed for Grand County and Jackson County which have received CDOT and NWRPC approval.

 

4. Personnel: the Consultant and the TAC will accomplish this activity with the Consultant completing all necessary revisions. The Boards of County Commissioners will (a) arrange for and publicize any applicable website, the four public meetings and the Consultant's addresses at which written comments will be received, and (b) will distribute and/or post hard copies of the draft and final TDP in each community of Grand and Jackson County.

 

POST-TDP & TASK 10

 

1. Objective: To obtain necessary funding to implement TDP recommendations.

 

2. Approach: The Consultant will also be available to assist in obtaining any necessary NWRPC certification and in preparation of any grant applications for submittal to the Colorado Department of Transportation Complete to cause Grand and/or Jackson County to be included in federal and state transportation funding cycles.

 

3. Product: Assist TAC to complete necessary funding applications.

 

4. Personnel: The TAC will be primarily responsible completing this task, with the assistance of the TDP Consultant.

 

POST-TDP & TASK 10

 

1. Objective: To obtain necessary funding to implement TDP recommendations.

 

2. Approach: Obtain any necessary NWRPC certifications and complete all necessary applications to cause Grand and/or Jackson County to be included in federal and state transportation funding cycles.

 

3. Product: Completed funding applications.

 

4. Personnel: TAC and its members.

 

5. Timeline: November 1, 2000-March 1, 2001

 

POST_TDP & TASK 11

 

1. Objective: To create any necessary organizational structure and obtain any necessary voter approval to implement TDP recommendations.

 

2. Approach:

a. Assist TAC in public advocacy efforts to implement TDP recommendations.

 

3. Products: TDP recommendations substantially implemented.

 

4. Personnel: TAC, its members and subcommittees with the assistance of the TDP Consultant(s)' staff.

 

 

POST-TDP & TASK 11

1. Objective: To create any necessary organizational structure and obtain any necessary voter approval to implement TDP recommendations.

 

2. Approach:

a. Hire legal and/or funding consultant to prepare necessary paperwork to create recommended organizational structure.

 

b. Timely submit to County Clerks and Recorders all necessary paperwork regarding any recommended transit ballot issue(s).

 

c. Hold public informational/advocacy meetings explaining public benefits expected to follow from approval of transit ballot issue.

 

d. Advocate for approval of necessary transit ballot issues to implement final TDP.

 

3. Products:

a. Legal, completed, structural organization to provide public transit services in Grand and/or Jackson Counties.

 

b. Ballot issue submitted to local voters for consideration of recommended transit funding alternative.

 

c. TDP recommendations substantially implemented.

 

4. Deadlines:

a. November 1,2000-March 1, 2001, public advocacy, initiative, petition signature period

 

b. May 1, 2001, legal deadline for transit ballot issue paperwork

 

c. November 2001, election on submitted transit ballot issue.
